By accessing or using our Site or Services – including scheduling appointments or using our online chatbot – you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, please do not use the Site. You are expected to review these Terms periodically because we may revise and update them at any time. All changes are effective immediately when posted, and your continued use of the Site after such changes constitutes your acceptance of the new terms. Accuracy and Advice: We strive to keep information up to date but make no guarantee of completeness. Do not rely solely on the Site for diagnosis or treatment – consult a licensed dentist for personalized care.

Similarly, our chatbot provides automated responses and should not be used for urgent medical inquiries. In the event of an emergency, please call 911 or visit the nearest hospital rather than relying solely on our online tools. Embedded Content: For example, the Google Maps widget on our Site is provided “as is” by Google. We do not control updates or errors in the map content. Similarly, the appointment scheduling system is hosted by an external provider. Any technical issues with that system are not the responsibility of Smile Plus.

Third-Party Liability: Smile Plus and our staff “do not assume any responsibility for your illegal, unauthorized, or improper use of information transmitted” via third-party tools. We disclaim all warranties related to such content; by using these services, you agree to do so at your own risk.

Patient Responsibilities

You agree to use the Site and Services in good faith and compliance with all applicable laws. This includes providing accurate and up-to-date information and promptly notifying us if your contact or medical details change. You are responsible for keeping your login (if any) or scheduling confirmation secure and for all activity that occurs under your name. Please follow all instructions given by Smile Plus staff during scheduling and treatment.

You should maintain your backup of any critical communications or documents. For example, if you receive an appointment confirmation by email or text, be sure to save it. If you need to cancel or reschedule an appointment, please do so in advance, following our cancellation policy. Failure to attend appointments without timely notice may result in a fee. Service Limitations and Disclaimers

Smile Plus’s Site and Services are provided “as is” and “as available.” We make no guarantees about the services or the Site. In particular:

No Medical Guarantee: The Site does not substitute for professional care. Smile Plus does not warrant or guarantee any specific outcomes from dental treatment or that our services will solve any particular health issue.

No Availability Guarantee: We do our best to respond promptly, but we do not guarantee immediate availability of appointments, responses, or technical support. We may need to cancel or reschedule appointments due to unforeseen circumstances (such as emergencies) without liability.

No Liability for Errors: As PDS’s policy puts it, “all information and services…are provided ‘as is, as available’ without warranty”. We disclaim all implied warranties, including merchantability or fitness for a particular purpose. Smile Plus will not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or Services. This includes (but is not limited to) lost profits, lost data, or business interruption. In no event will our total liability to you for any claim exceed the amount you have paid us for the specific service in question.

No Warranty of Perfection: We cannot guarantee that the Site will be error-free, secure, uninterrupted, or free from viruses or malicious code. Suppose the Site is temporarily unavailable for any reason. In that case, we will not be liable for any damages resulting from the outage. You are responsible for taking precautions, such as using antivirus software and secure networks, when using our Site.

1. Program Description
Smile Plus Dental offers an SMS/Text Messaging program to keep you informed about your dental care. By opting in on our website (smileplushomestead.com), you agree to receive recurring automated text messages from Smile Plus Dental relating to your interactions with us. These messages may include appointment reminders, scheduling confirmations, follow-up care instructions, promotional offers, and other updates relevant to our services. Messages will be sent from our dedicated phone number, +1 (786) 572-0250. Your consent to receive these texts is voluntary and not a condition of any purchase or service.

2. Opt-Out Instructions (STOP)
You can cancel the SMS service at any time. To opt out, simply text “STOP” to +1 (786) 572-0250. After we receive a STOP request, we will send a one-time confirmation SMS to let you know you have been unsubscribed. Once you opt-out, you will no longer receive text messages from us. If you ever wish to rejoin the program after opting out, you will need to opt in again through our website (as you did initially), and we will resume sending you SMS messages.

6. Recurring Messages Disclosure
By enrolling in the Smile Plus Dental messaging program, you will receive recurring text messages from us until you choose to opt-out. This is not a one-time message service; notifications will be sent on an ongoing basis as needed (for example, multiple reminders leading up to an appointment or periodic promotional updates). Message frequency varies based on your interaction with us and your upcoming appointments. 7. Prohibited Content

In particular, we will not send any messages that contain or promote content related to sex, hate, alcohol, firearms, or tobacco (commonly known as “SHAFT” content). We also will not send messages that are fraudulent, misleading (such as phishing attempts), harassing, or otherwise unlawful.
